Garfield County, Colo., commissioners approved plans for the continued operation of a Lafarge concrete batch plant along Highway 82 outside Carbondale, however, a new nearby gravel plant that would supply the plant is the subject of a lawsuit filed by neighbors, according to local media.

The plant is currently operating using aggregate from a gravel operation at the northwest corner of Highway 82 and Garfield County Road 103. However, that site is nearing the end of its permitted life, and is to be reclaimed by April 18, 2013, with the exception of the concrete plant. At issue is the newly approved Cerise gravel pit, to be located at the northeast corner of the intersection.

Commissioners approved plans for that new pit in July. However, a group of homeowners has sued the Garfield Board of County Commissioners alleging that the board “exceeded its jurisdiction and/or abused its discretion” with the approval.
A condition for the approval of the concrete plant was that material be hauled from the new Cerise pit.
